Abdulhekim Esiyok, 23, was killed and four other victims were injured after a driver plowed into a group of people in Manhattan. According to news reports, 26-year-old Mahbub Ali has been charged with manslaughter, DWI and related offenses after the incident, which occurred on Third Avenue near 21st Street the night of June 4. An eyewitness said the sound of the sedan swerving, striking several pedestrians, and crashing into a kiosk sounded “like a grenade going off.
Fatality and Injuries
Police said Ali, a Queens resident, was intoxicated and may have been trying to avoid a bicyclist when he crashed into the crowd of people. Esiyok was transported to an area hospital where he succumbed to his injuries from the pedestrian accident.
A 26-year-old female pedestrian remains hospitalized in critical condition with a fractured leg. A 21-year-old pedestrian is stable after suffering a laceration to his left leg. An 18-year-old male bicyclist who was struck and a 25-year-old woman who was a passenger in Ali’s car were also taken to a hospital. The 18-year-old suffered leg and back injuries while the 25-year-old broke her right leg, according to reports.
The New York Post reported that Esiyok was a migrant from Turkey who had come to New York City in search of a job and a better life for him and his family. Our thoughts and prayers are with Esiyok’s family and all the injured victims of this horrific crash.
Driving While Impaired
Driving while under the influence of alcohol and/or drugs has the potential to cause pedestrian accidents that result in catastrophic injuries or even death. Under New York law, it is illegal to operate a vehicle while under the influence of alcohol and/or drugs. In addition to facing criminal charges, impaired drivers can also be held financially responsible for the injuries, damages and losses they cause.
Driving under the influence of alcohol or drugs increases the risk of accidents due to impaired motor skills, reduced focus and reaction times, decreased vision and poor judgment. These effects put the driver and passengers at risk, as well as others on the roadway such as pedestrians and bicyclists.
Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.
Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
