An explosion at a New York City Housing Authority (NYCHA) building, the morning of Oct. 1 in the Bronx, caused an entire corner of the high-rise to collapse, according to a CBS news report. Videos from the news outlet showed a gaping hole in the side of the 20-story building, which is part of Mitchel Houses in the Mott Haven section of the borough. Extensive damage can also be seen along Alexander Avenue. No injuries were reported as a result of the explosion and building collapse.
Mayor Eric Adams who visited the scene told reporters that an explosion in the boiler room resulted in the partial building collapse and that it was extremely fortunate there were no injuries or loss of life as a result. Witnesses reported hearing a loud boom and then seeing a part of the building collapse. The blast sent bricks, air conditioning units and other debris raining down onto nearby buildings and the sidewalk below, CBS reported.
Ongoing Investigation
According to the most recent NYCHA data, Mitchel Houses has about 3,500 residents in 1,730 units across 10 residential buildings. The complex was built in 1966 and spans two city blocks East 135th to 137th streets. Officials evacuated affected residents and gas has been shut off for the entire complex due to ongoing inspections, the report said. Based on the CBS news report, this incident was similar to the December 2023 building collapse in the Bronx when several tenants were displaced, but no one was injured.
The City reported that Wednesday was the first day of New York’s official heat season when many residential buildings have their boilers turned on for the first time. NYCHA’s Chief Operating Officer Eva Trimble told The City that all boilers are examined before the beginning of the heat season, but did not comment on when the specific boiler at Mitchel Houses had been inspected.
A city buildings commissioner told the outlet that work was being done on that boiler, but did not provide details. He also said there were three open violations on boilers at Mitchel Houses, but said they were for non-safety reasons and said the Department of Buildings (DOB) does not know if those violations caused or contributed to Wednesday’s explosion. The department’s records show that DOB inspectors on June 25 ordered all plumbing work at the site to stop because of work being done under an expired license.
Liability in Building Collapse Incidents
Under New York’s premises liability law, a property owner/property manager or a landlord (building owner) is required to exercise reasonable care of the property. They are required to inspect the property regularly. They must also regularly maintain the property, which includes checking for hazards and repairing those dangerous conditions. Building owners/managers are also required to warn tenants and those living or working on their property about existing dangerous conditions.
Generally speaking, property owners/property managers can be held liable if there are structural issues that result in injuries. Whether it’s a floor collapse, stairway collapse or wall or balcony collapse, the responsibility typically falls on property owners or property managers because they have an obligation to inspect, correct the defects and warn tenants about possible dangers in a timely manner.
