Man Killed in Staten Island Bicycle Accident

A man was fatally injured in a Staten Island bicycle accident after he was struck by an SUV on a residential street. According to a Streetsblog news report, the victim, a man in his 40s, was cycling on Wilson Avenue near the intersection of Armstrong Avenue the morning of Feb. 24 when he was hit by the 35-year-old driver of a gray Infiniti SUV.

The driver of the SUV then slammed into a parked car and a roadway sign before coming to rest against a tree. Streetsblog reports that the damage to the vehicle suggests a high rate of speed, but that the NYPD declined to provide any additional details about the crash. The bicyclist suffered severe body trauma and was taken to a local hospital where he died.

The woman who drove the SUV was not immediately charged. Wilson Avenue runs parallel to the Staten Island railway line and often serves as a cut-through road for drivers. Last year, according to city records, there were 10 reported crashes on the roadway injuring three pedestrians and two motorists. We offer our deepest condolences to the family of the deceased bicyclist for their tremendous loss.

Bicycle Accidents Caused by Negligence (Carelessness)

There are a number of reasons why collisions occur at street intersections between cars and bicyclists. Many of these accidents tend to happen because the driver was negligent (careless) behind the wheel at the time. Often, bicyclists are hit by drivers who are distracted, speeding or fail to yield the right of way. Some drivers drift into bike lanes putting bicyclists in serious danger. In this particular instance, reports state that the driver of the SUV may have been driving at a dangerous rate of speed before the collision.

These types of accidents can result in serious injuries such as traumatic brain injury, spinal cord trauma, multiple broken bones, internal organ damage or even death. When a passenger vehicle or a larger vehicle such as a bus or truck and a bicycle collide at an intersection, it is important to look into the factors that led to it including, who had the right of way at the intersection. Under New York law, bicyclists have the same rights as drivers of other vehicles.

In cases where negligence (carelessness) is involved, families of deceased bicycle accident victims can file a wrongful death lawsuit seeking compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering, and loss of care and companionship.

Victims who have been injured in a bicycle crash, may be able to seek compensation for damages including medical expenses, lost income and benefits, hospitalization, cost of rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. A knowledgeable New York bicycle accident lawyer will be able to guide victims’ families through what is often a complex legal process to obtain compensation.
