Man Killed in Queens Pedestrian Accident

Pedestrian AccidentA 32-year-old pedestrian suffered fatal injuries after being struck by a driver who officials say was speeding and had received a dozen speeding tickets in a year. According to Streetsblog.org, the driver was northbound on North Channel Bridge in Queens when he hit the victim who was crossing the span at a parking area near Cross Bay Boulevard. The victim’s name has not been released. The driver remained at the scene and police said they made no arrests and did not issue any summonses. We offer our deepest condolences to the family of the deceased pedestrian for their tremendous loss.

Speeding and Pedestrian Accidents

Streetsblog reported that the driver’s vehicle has racked up 27 speeding tickets since 2019 including 11 in the period between March 11, 2022 to March 10, 2023 — all of them in Queens. The 11 tickets are in a 12-month period, just four shy of the number that could require the driver to take a city-run safe driving course or risk their vehicle being impounded by the authorities under the Dangerous Vehicle Abatement Program.

Only a few hundred people have taken the course though more than 20,000 people have hit the 15 speeding ticket threshold, records examined by Streetsblog show. In this particular case, the car could not have been towed away because all but one of the tickets had been paid. Also, tickets issued by speed cameras do not count on a driver’s record. Safety advocates are urging the state Assembly to pass Sammy’s Law, which would allow New York City to set its own speed limits.

According to Streetsblog, less than 3% of the worst drivers have taken the driver accountability tests. The city’s own database shows that more than 22,300 cars had been slapped with 15 or more speeding tickets or five or more red light tickets as of December, but only 630 drivers had taken the safe driving course. Just 12 vehicles had been seized because the owner did not take or complete the course, Streetsblog reported.

Compensation for Pedestrian Accidents

Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
