Man Killed in Queens Pedestrian Accident

A man was killed in a pedestrian accident in Queens. According to a report in the New York Daily News, officials said the 55-year-old man was attempting to cross Queens Boulevard at 84th Drive in Briarwood when he was struck by a sedan. The pedestrian was thrown onto the hood of the car before smashing into the windshield shattering it, and then landing back on the pavement. Witnesses said the victim was lying on the ground with a lot of blood coming from his head.

Severe Injuries Reported

Paramedics rushed the man who had suffered severe head trauma to a local hospital where he died from his injuries two days later. He apparently lived half a mile from the scene of the collision. Police say the 33-year-old woman driving the car was stopped at the red light moments before striking the man who was in or very close to the crosswalk and had the “walk” signal.

When the light turned green, the woman made a left turn off 84th Drive onto Queens Boulevard and hit the pedestrian. The driver remained at the scene and faced no immediate charges. Family members said the man was visiting his mother who lives three blocks away when he was struck. They also told the Daily News that he had suffered bleeding in the brain and that the back of his skull was broken. Doctors had to do emergency surgery.

The section of roadway where the pedestrian was struck was once known as the “boulevard of death” because of the high number of people who were killed in traffic accidents along the street. However, the situation improved after the Bill de Blasio administration undertook a redesign of the boulevard with a new bike lane and safer pedestrian crossings. Officials had to pause the final leg of the street’s redesign when the pandemic hit.

Pedestrian Accidents at Street Intersections

Street intersections can be extremely dangerous for pedestrians. We’ve seen a number of pedestrian accidents, many of them fatal incidents, as a result of vehicles failing to yield the right of way to pedestrians at street intersections, especially as the driver is making a turn. New York laws state that pedestrians have the right of way in all crosswalks and intersections with marked or unmarked crosswalks. The law also states that motorists turning right or left at an intersection should always look for pedestrians and yield the right of way to them. Pedestrians have the right of way at intersections, even if drivers have a green light.

Injured victims of pedestrian accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
