Wenntwen Porgho, 43, was killed in a bicycle accident in the Bronx after a driver who was making a left turn at a street intersection struck him. According to a report on Streetsblog.com, the fatal bicycle accident occurred the night of July 21. The driver of a sedan was making a left turn onto Williamsbridge Road from southbound Bronxwood Avenue. Porgho suffered severe body trauma. He was transported to a local hospital where he died from his injuries.
Dangerous Streets and Intersections
Streetsblog.com reports that even though police have not said if the driver, who
remained on the scene, cut the corner while making the turn, a preliminary investigative report from NYPD suggests the driver may have failed to yield the right of way to the bicyclist. However, no charges have been filed against the driver. So far, there have been 18 reported crashes at or adjacent to this intersection since January 18, according to Streetsblog.
Porgho is the 11th bicyclist to be killed this year in the city. His death followed a pedestrian accident fatality in Bay Ridge on July 17. Police said a 67-year-old woman was crossing Seventh Avenue when she was knocked down by the driver of a van that had turned from westbound Ovington Avenue onto Seventh. That victim, identified as Monica Chen, died from her injuries as well.
State Senator Andrew Gournades and City Council Member Justin Brannan said in a joint statement that the driver in that crash claimed he did not see Chen in spite of the fact that the crash occurred in broad daylight at an intersection that had pedestrian interval signals and with the leading streets providing an unobstructed view of the intersection. NYPD officials have not commented on these crashes or whether either of the drivers would be criminally charged.
Holding At-Fault Parties Liable
In criminal cases, the burden of proof is on the prosecution. However, victims in pedestrian and bicycle accident cases or families that have lost loved ones in these tragic situations, can file a civil personal injury or wrongful death lawsuit against the at-fault parties, even if no criminal charges are filed.
The plaintiff’s (the injured party’s) lawyer in a civil trial will have to show liability through a preponderance (majority) of the evidence. This means that your lawyer will show evidence that the driver involved was negligent (careless) at the time of the accident and that you should receive compensation for the resulting injuries, damages and losses.
Injured victims of speeding or reckless drivers can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
