A man was killed in a bicycle accident in Queens after being struck by an MTA bus. According to a PIX11 news report, the fatal collision occurred in Laurelton at the intersection of 238th Street and 128th Avenue the morning of May 28. The bicyclist suffered head injuries and severe body trauma due to the impact and died at the scene, officials said.
Ongoing Investigation
The 59-year-old bus driver who remained at the scene has been pulled off service while the crash is being investigated by the NYPD and internally by the MTA. We offer our deepest condolences to the family members of the deceased victim. They will be in our thoughts and prayers.
Officials with the MTA called this bus collision a “tragic incident” and that they are cooperating with the NYPD’s Collision Investigation Squad, “which is in the early stages of its review and will determine the facts.” So far, four bicyclists have been killed in New York City in 2022, which is one more compared to the same time last year, according to NYPD officials.
Street Intersection Accidents
There are a number of reasons why accidents occur at street intersections between cars and bicyclists. Many of these accidents happen because of a driver who is negligent or careless behind the wheel. Often, bicyclists are hit by drivers who are distracted by a cell phone. In other situations, drivers may be traveling too fast through an intersection and may not be able to stop in time to avoid hitting the bicyclist.
These types of accidents can result in serious injuries such as traumatic brain injury, spinal cord trauma, multiple broken bones, internal organ damage, etc. When a bus or a public transport vehicle and a bicycle collide at an intersection, it is important to look into the factors that led to it including, who had the right of way at the intersection. Under New York law, bicyclists have the same rights as drivers of other vehicles.
In cases where negligence (carelessness) is involved, families of deceased bicycle accident victims can file a wrongful death lawsuit seeking compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering, and loss of love, care and companionship.
If you have been injured in a New York bicycle accident, you may be able to seek compensation for damages including medical expenses, lost income and benefits, hospitalization, cost of rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. An experienced New York personal injury lawyer will be able to guide victims’ families through what is often a complex legal process.
