Fatal Brooklyn Garbage Truck Accident Raises Safety Concerns

Eric Salitsky, a 35-year-old Borough Park architect, was killed in a bicycle accident involving a garbage truck the evening of May 5. According to Streetsblog.org, the NYPD has issued multiple summonses to the 62-year-old driver of the privately-owned Volvo garbage struck that struck and fatally injured Salitsky on Ninth Avenue at the MTA’s 38th Street Yard.

Salitsky suffered head and body trauma and died at a local hospital. The driver initially fled, but was located shortly afterward, police said. NYPD officials said the garbage truck operator “was not aware” immediately that he was involved in the collision. NYPD officials have not said what the summonses were for, but the driver did not appear to have been arrested, Streetsblog reports. We offer our deepest condolences to the family members of Eric Salitsky for their terrible loss.

Bicycle Safety Issues

Streetsblog reports that a number of MTA employees’ vehicles and even one NYPD Transit police vehicle had been illegally parked in the “No Parking” zone on the southbound side of Ninth Avenue where Salitsky was struck and killed. In addition to having a sign alerting drivers that they need to yield to bicyclists, the narrow two-way Ninth Avenue is also a bus route. According to Streetsblog, Borough Park is one of the least safe neighborhoods for bicyclists with no protected bike lanes.

Salitsky is the third bicyclist killed by a driver on city streets so far this year — up from the two fatalities that occurred by this time last year. In 2019, before the pandemic, vehicles had fatally struck seven bicyclists by early May, according to NYPD. Salitsky is also the fourth person to be killed by a garbage truck in the city this year and one of six people killed by vehicles in the city in a 72-hour period, according to the bicycling advocacy group, Transportation Alternatives.

Liability Issues

Bicyclists and pedestrians who have been struck by private sanitation trucks have the right to seek compensation.
