Elderly Woman Critically Injured in Queens Pedestrian Accident

An 82-year-old woman was severely injured after a driver failed to yield and struck her as she was attempting to cross the street in Bayside, Queens. According to a report on Patch.com, the pedestrian accident occurred when the driver of an SUV made a left turn from Corporal Kennedy Street onto 43 Street and hit the victim who was in the street. The pedestrian was transported to a local hospital in critical condition.

Dangers for Pedestrians

The news article doesn’t mention if police arrested or cited the driver here but stated that the person did not comply with state law and failed to yield to the pedestrian who was crossing the street legally in a marked crosswalk. The intersection where this pedestrian accident occurred is a four-way stop with marked crosswalks for pedestrians at every part of the intersection.

But, neighbors say this hasn’t exactly prevented accidents in the past. Patch.com also reports that in a neighborhood Facebook post about the accident, one person wrote that the intersection where this accident occurred is very dangerous. Another neighbor said motorists routinely run stop signs on Corporal Kennedy Street and cited an incident that happened at the 39 Avenue intersection, which they said prompted the city to replace a traffic sign with a traffic light.

This particular incident comes right after 2021 was deemed the second-deadliest traffic year under Mayor Bill de Blasio, especially for pedestrians who comprise 43 out of 70 traffic deaths from Jan. 1 to April 30 of this year, according to city data compiled by Transportation Alternatives, a traffic safety advocacy group.

Failure to Yield

Some of the deadliest pedestrian accidents occur in crosswalks and at street intersections. Failure to yield the right of way to pedestrians is one of the most common causes of vehicle versus pedestrian accidents in crosswalks and at street intersections. New York law requires drivers to come to a complete stop at a crosswalk where pedestrians are walking and wait until pedestrians have crossed the road and it is safe for them to proceed.

Impairment, inattention and/or distraction tend to be factors that are cited in such cases where a driver fails to see a pedestrian who is crossing at an intersection. When this occurs, the at-fault driver can be held liable for the injuries, damages and losses caused. Some of the common injuries suffered in these types of accidents include traumatic brain injury, spinal cord damage, broken bones, internal organ damage, etc.
