Driver Charged with Failure to Yield in Brooklyn Pedestrian Accident

Pedestrian AccidentThe driver of a pickup truck who struck and killed a woman pushing her 2-year-old granddaughter in a stroller has been charged with failure to yield, police say. According to a report in the New York Daily News, Faheem Shabazz was southbound on 25th Avenue and driving a pickup truck when he turned left onto Bath Avenue in Bath Beach and hit the victim who was walking in a crosswalk, police said.

Fatal Crosswalk Accident

The truck was turning and it collided with the woman, causing the baby to be thrown from the stroller, according to a witness who also said that the grandmother was on her back and bleeding from the head. Xia Ying Chen, 66, suffered severe head and body trauma and was rushed by paramedics to a local hospital, but succumbed to her injuries. Shabazz has been charged with failing to yield to a pedestrian in a crosswalk.

The victim’s granddaughter was injured in the crash, according to another witness. Officials said she is expected to make a full recovery. Shabazz, who is an MTA driver, has been suspended from his job pending an MTA investigation into this fatal crash. We offer our deepest condolences to Chen’s family for their heartbreaking loss.

Right-of-Way Laws in New York

Under New York laws, drivers are required to yield the right of way at crosswalks. A crosswalk is “defined as any area distinctly indicated for pedestrian crossing by lines or other pavement markings.” A crosswalk is also any part of the road at an intersection between the curbs on opposite sides of the roadway or, if there are no curbs, between the edges of the road. This area is considered a crosswalk, whether or not it is marked as one.

When there are no pedestrian signals at an intersection, motorists must wait until vehicle traffic gets a green light in the same direction. Do not cross the front of traffic that has a green light. If there is a crosswalk at a location where there are no traffic control signals for drivers or pedestrians, drivers must yield the right of way to pedestrians.
