Brooklyn Pedestrian Fatally Injured by Garbage Truck

A 62-year-old man was killed in a pedestrian accident after he was struck by a private garbage truck at a Brooklyn intersection near Barclay’s Center. According to a report on Streetsblog, the 37-year-old driver behind the wheel of a private trash hauler was heading north on Flatbush Avenue when he ran over the victim who was crossing Atlantic and Flatbush avenues near the Atlantic Terminal Mall. We offer our deepest condolences to the family members of the deceased victim. They will be in our thoughts and prayers.

Crashes Involving Sanitation Trucks

The large truck was stopped just feet from the edge of a faded crosswalk, according to Streetsblog, which also reports that investigators from the NYPD’s Collision Investigation Squad, the Brooklyn District Attorney’s Office, Department of Transportation, and the city’s Business Integrity Commission, which oversees the private carting industry, were all present at the intersection after the fatal incident.

The news article states that the private carting industry has come under scrutiny over the past several years after a number of fatal crashes and incidents of reckless driving. The NYPD vowed to crack down on dangerous and reckless garbage truck drivers. The city requires every truck above 10,000 pounds to install life-saving guardrails by 2024, a safety feature that prevents pedestrians and bicyclists from being swept under the massive vehicles’ rear wheels.

It is not clear whether the truck involved in this most recent pedestrian collision in Brooklyn was fully equipped with these side guards. The intersection where this crash occurred is one of the most dangerous in the city. Streetsblog reports that last year alone, there were 53 reported crashes at the intersection of Flatbush, Atlantic and Fourth avenues, also known as Times Plaza, injuring three cyclists, three pedestrians and seven motorists. The New York City Department of Transportation reports that 42 people have been killed on city streets through March 2 of this year, up from 26 people over the same period last year. Of the 42 deaths this year, 20 have been pedestrians.

Liability Issues

Victims of New York pedestrian accidents may be able to seek compensation for damages including medical expenses, lost income and benefits, hospitalization, cost of rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. If you have lost a loved one in a pedestrian accident, you may be able to seek compensation by filing a wrongful death lawsuit against the responsible parties.

In this case, in addition to the driver, his or her employer (the sanitation company) and the owner of the truck can also be held liable. A knowledgeable pedestrian accident lawyer can provide you with more information about how to file a lawsuit and help you receive maximum compensation for your losses.
