Brooklyn Apartment Fire Injures 16 People Including Two Children

Apartment Fire accident lawyerSixteen people were injured, including two children, when an early morning fire ripped through a Brooklyn apartment building on Jan. 15. According to the New York Post, the fire erupted on the building’s second floor on Bay 19th Street near 86th Street in Bath Beach. FDNY officials said they found heavy fire on arrival and that they were also confronted with a fire door in the apartment that was left open. The open door allowed the blaze to spread up to the third floor where firefighters rescued two young boys — a 5-year-old and 5-month-old — in addition to a 42-year-old man. All the victims are said to be in stable condition.

Six firefighters were hospitalized with non-life-threatening injuries and seven more civilians were treated at the scene. The two-alarm fire drew 106 firefighters and 25 medical personnel to the scene. The cause of the fire is still under investigation. Our thoughts and prayers are with the injured fire victims and we wish them the very best for a quick and full recovery.

The Danger of Open Fire Doors

Fire doors play a crucial role in containing fires and preventing the rapid spread of flames, smoke, and toxic gases in buildings. When left open, they significantly compromise the safety of occupants and emergency responders. Open fire doors allow fire and smoke to travel quickly through corridors, stairwells and other critical escape routes, turning a manageable fire into a catastrophic event.

In New York, where many buildings have complex layouts and high occupancy levels, the risks of open fire doors are amplified. Even when fire doors are left propped open for convenience, it can become extremely dangerous. During a fire, these open pathways can create a “chimney effect,” where hot gases and flames are funneled upwards, endangering occupants on multiple floors.

The consequences of open fire doors are evident in several high-profile New York fires, where failure to close the doors exacerbated fatalities and property damage. Fire safety experts stress the importance of educating building owners/managers and staff about the critical function of fire doors. Additionally, building managers and owners must ensure compliance with local fire codes, which often require self-closing mechanisms and regular maintenance for fire doors. Proper use of fire doors can save lives by providing occupants with more time to evacuate and creating safer conditions for firefighters to contain the blaze. Self-closing fire doors, even in non-emergency situations, is a simple yet vital step in reducing fire-related risks.

Property Owner’s/Manager’s Responsibilities

In New York, property owners/managers have specific legal responsibilities regarding the installation and maintenance of smoke detectors to ensure tenant safety. According to New York City law, property owners/managers must install at least one operational smoke detector in each apartment or dwelling unit. These devices must be placed near each sleeping area, and the alarms must meet standards set by FDNY.

In addition to installing the detectors, property owners/managers are responsible for replacing any smoke detectors that become defective. The law requires that these smoke detectors be equipped with a non-removable, non-replaceable battery that lasts at least 10 years.

Property owners/managers are also required to provide written instructions on how to properly maintain the detectors and what to do in case of malfunction. Failure to comply with smoke detector regulations can result in fines for property owners/managers, especially if it leads to unsafe living conditions. Ensuring that smoke detectors are installed and maintained is a critical part of a building owner’s/manager’s responsibility to promote fire safety in rental properties.
