Malcom Livesey, 18, was killed in a Brooklyn bicycle accident after he was hit and run over by an Amazon delivery truck. According to media reports, the deadly delivery truck accident occurred along First Avenue near East 17th Street, close to where the victim lived — in Stuy Town. Streetsblog.org reports that Livesey, who was riding a Citi Bike and the Amazon truck driver were both heading up First Avenue the afternoon of June 16 with the bicyclist in the center lane and the truck driver one lane to the right.
Surge in Fatal Bicycle Accidents
Police said the collision occurred when a vehicle changed lanes. No arrests were reported and there were no charges filed against the truck driver pending an official investigation, according to reports. We offer our deepest condolences to the family members of Malcom Livesey for their tragic loss.
On June 13, a 37-year-old woman riding a Citi Bike was killed in a collision with a box truck, also in Brooklyn. The woman was riding the e-bike east on Ninth Street near Second Avenue in Gowanus when she collided with a box truck heading in the same direction. The bicyclist was pronounced dead at the scene. No arrests have been made in that incident, pending an official investigation.
Livesey is the 18th person to be killed this year in the city while riding a bicycle, according to the New York City Department of Transportation (DOT). This crash occurred as the NYPD announced that bicyclist fatalities are up 260% in the first six months of 2023.
They have surged 325% since the implementation of Vision Zero by Mayor Bill de Blasio’s administration a decade ago. The Department of Transportation says it is adding dozens more bike lanes. But safety advocates say the city is way behind on its promise of 250 miles of protected bike lanes by the year 2026.
Compensation for Victims
If you have been struck by a delivery or commercial truck, there are a number of steps you can take to protect your rights. Make sure you get prompt medical attention. Obtain as much information as possible about the truck and driver including his or her driver’s license, name and contact information as well as insurance policy details. Also, gather as much evidence as possible from the scene including photos, videos and testimony from eyewitnesses. Contact an experienced New York bicycle accident lawyer who has experience handling delivery truck accident cases. Your lawyer can also help gather evidence from the accident site.
In cases where negligence (carelessness) is involved, families of deceased bicycle accident victims can file a wrongful death lawsuit seeking compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering, and loss of care and companionship. An experienced New York personal injury lawyer will be able to guide victims’ families through what is often a complex legal process.
