A 13-year-old bicyclist, who was on his way to a Brooklyn synagogue, suffered life-threatening injuries in an auto accident after he was struck by a van. According to a report in the New York Daily News, the major injury bicycle collision occurred at the intersection of 12th Avenue and 47th Street in Borough Park. The bicycle collided with a Honda van at the intersection. The boy, who was apparently headed to prayer services ahead of the upcoming Jewish High Holy days, was thrown off the bike. The teen was transported to an area hospital in critical condition. So far, no citations or arrests have been reported.
New York Bicycle Accident Statistics
According to the New York Department of Motor Vehicles, in 2010, there was a total of 6,276 bicycle accidents in which 36 bicyclists were killed and 6,025 were injured. Among those who were injured, 665 suffered serious injuries, 1,831 sustained moderate injuries and 3,133 suffered what were described as minor injuries. During the same year, in all of the fatal bicycle versus vehicle accidents that occurred, it was the bicyclist who was killed.
Bicycle Accident Causes
New York law states that bicyclists have the same rights and responsibilities as drivers of other vehicles. This means that bicyclists have the same right-of-way privileges as other drivers at street intersections. Most vehicle versus bicycle accidents occur at street intersections because drivers fail to consciously look for bicyclists at these locations. There are a number of questions that must be asked in the aftermath of a serious injury bike accident. Was alcohol a factor? Was the driver distracted or inattentive? Did the driver fail to yield the right-of-way or run a red light? It will be important to examine these issues and more in order to determine how or why the collision occurred and who was at fault.
Compensation for Injured Victims
Injured victims of bicycle accidents have legal rights. Victims can seek compensation to cover damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, past and future pain and suffering, etc. Our law firm recovered $600,000 for the estate of a bicyclist who witnesses say was killed when he rode his bicycle through a red light at an intersection. He was also found to have marijuana in his system. We had no witnesses for our client’s side and were still able to accomplish this remarkable result for the victim’s family.
