Woman in Wheelchair Killed in Brooklyn Pedestrian Accident

A 69-year-old woman in a wheelchair has suffered fatal injuries in a Brooklyn pedestrian accident after she was struck by a vehicle at a street intersection the evening of July 30. According to Pix11, the fatal pedestrian accident occurred when the woman was crossing McDonald Avenue in Kensington. The news article states that a 73-year-old woman was driving south on McDonald Avenue near Webster Avenue when she swerved to avoid hitting another car and ended up striking the pedestrian who was in a wheelchair and crossing the street.

The pedestrian was trapped under the car and a group of passersby attempted to help by getting a jack to lift the vehicle off the woman. The victim was rushed to an area hospital where she was pronounced dead. The driver of the vehicle remained at the scene. Many neighbors said they had seen the victim in the area for decades. Police said the highway division is investigating the fatal incident. No charges have been filed yet. Our deepest condolences go out to the victim’s family. They will be in our thoughts and prayers.

Negligence (Carelessness) in Pedestrian Accidents

Under New York law, any person who is walking on foot or using a wheelchair is considered a pedestrian. The law also requires motorists to exercise due care and caution around pedestrians — whether or not they are in a crosswalk. Pedestrian accidents that occur at street intersections typically result in catastrophic injuries or fatalities.

Recently, Mayor Eric Adams issued a public statement promising to punish drivers if they kill, injure or put pedestrians in danger by failing to yield. Mayor Adams and the city’s top police officials have vowed to take strong steps to enforce the city’s Right of Way law. Even though New York City has required motorists to stop and yield to pedestrians in crosswalks and at street intersections, drivers often do not obey the law.

Injured victims of pedestrian accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
