Jim Jones, 55, of Fall River, was killed in a Long Island pedestrian accident the night of Nov. 13. According to a news report, Jones was trying to cross Veterans Memorial Highway in a crosswalk at Fifth Avenue when he was struck by a sedan in the westbound lanes. Jones was transported to Stony Brook University Hospital where he was pronounced dead. Officials identified the driver of the vehicle as 64-year-old Erin Archibald of Smithtown. Our thoughts and prayers are with the family of Jim Jones for their tragic loss.
In New York State, pedestrians have specific legal rights under the Vehicle & Traffic Law that prioritize their safety when using crosswalks. Under Section 1151, drivers are required to yield to pedestrians in both marked and unmarked crosswalks at intersections, slowing or stopping if necessary. When a vehicle has stopped at a crosswalk to allow someone to cross, other drivers coming from behind may not overtake or pass it. Additionally, drivers must always exercise due care to avoid hitting pedestrians, whether or not they are in a crosswalk.
Crosswalk accidents can result in serious pedestrian injuries due to the vulnerability of people on foot and the force of impact from a vehicle. Common injuries include fractures to the legs, hips, ribs or arms, often caused when a pedestrian is struck directly or thrown to the ground. Head injuries are also frequent and can range from concussions to traumatic brain injuries, especially if the person hits the pavement or the vehicle’s windshield.
Soft-tissue damage such as sprains, strains, bruising and lacerations are also typical and may require extended recovery. More severe accidents can lead to spinal cord injuries, internal bleeding or organ damage, which may be life-threatening. Pedestrians may also suffer emotional trauma, including anxiety or post-accident stress. Crosswalk collisions tend to occur when a driver fails to yield, is speeding or is distracted and the resulting injuries to the victims can be significant even at relatively low vehicle speeds.

Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you. It is in the best interest of injured victims and their families in such cases to contact an experienced personal injury lawyer before contacting the people responsible for the injuries, and definitely before contacting or communicating with any insurance company, or their lawyers, investigators, or adjusters.
