Iraq Veteran Killed in New York Roller Coaster Accident

A 29-year-old disabled veteran who served in Iraq was killed in a New York roller coaster accident. According to an Associated Press news report, the fatal injury accident occurred on the Ride of Steel coaster at Darien Lake Theme Park Resort outside Buffalo. The man was ejected from the rollercoaster. The victim of this tragic roller coaster accident had lost both his legs to a roadside bomb in Iraq. On July 8, 2011 both he and the rollercoaster operator decided that his disability would not be a hindrance on the ride. There are two rides at the park that have specific body proportion restrictions, but the Ride of Steel was not one of them. An investigation is underway and the ride has been temporarily shut down.
According to the Consumer Product Safety Commission (CPSC), about 2,500 amusement ride accidents occurred in the year 2004. There were 57 reported non-occupational fatalities from mobile and fixed-site rides between the years of 1987 and 2002. Whenever an amusement park injury accident occurs, it must be determined what caused the accident and how it could have been prevented. Was the victim properly secured on the ride? Did the ride owner fail to properly maintain the ride? Did operator error play a role in the accident? Did negligence on the part of the workers or supervisor cause the crash? Should this ride operator have allowed the victim to ride given his physical limitations?
In cases involving negligence, the victim or the victim’s family may seek financial compensation for their loss by filing a civil lawsuit against the at-fault party. Damages that may be covered include, but are not limited to medical bills, funeral expenses, past and future pain and suffering, and lost future income and benefits.
