Accidents Caused by Improper Loading

Cargo that is not properly secured on large trucks can cause serious injuries to the occupants of other vehicles on the road. Accidents involving falling or unsecured cargo tend to occur in a number of scenarios including:

• Items that are not properly secured inside the trailer of a semi-truck can move around inside the trailer and fall on the roadway if the door accidentally opens while the truck is in motion.
• An accident involving a jackknifed truck or truck rollover may spill cargo on to the road that can also strike other vehicles or create dangerous obstacles.
• An overloaded or improperly loaded truck can cause the truck driver to lose control of the vehicle and crash.
• The straps used to hold cargo on a flatbed truck may snap causing items to fall from the truck. Drivers and trucking companies have a responsibility to make sure all cargo is properly secured.

Who Can Be Held Liable?

When accidents involving incorrectly loaded cargo occur, a number of different parties may be held responsible. For example, a trucking firm may be held accountable for not performing proper maintenance on a truck. Similarly, a company that was responsible for loading cargo on a truck may be held responsible because it did not follow procedures to ensure all cargo was properly secured. There are also situations where a truck driver can be held liable if he or she did not perform the necessary inspections before the trip or did not take steps to drive the truck safely while carrying the cargo.

Compensation for Injuries and Damages

Accidents caused by trucks often result in catastrophic or major injuries such as traumatic brain injury, spinal cord trauma, internal organ damage, multiple broken bones, amputations, etc. Such injuries can require significant medical treatment and rehabilitation and leave individuals with temporary or permanent disabilities that prevent them from working and earning an income.

Victims who have been injured in truck accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families of deceased accident victims may be able to file a wrongful death lawsuit seeking compensation for damages such as lost future income, funeral costs, medical expenses, pain and suffering, etc.
