A pizza deliveryman suffered critical injuries in a bicycle accident in Brooklyn the night of Nov. 21. According to a report in the New York Daily News, the 38-year-old bicyclist was crossing East 56th Street at Linden Boulevard in East Flatbush when he was struck by an SUV that was heading west on Linden. Witnesses said the bicyclist fell on to the street and was bleeding and unresponsive.
Emergency medical personnel rushed him to Kings County Hospital where he remained in critical condition the following day. The driver of the SUV, also 38, was transported to the same hospital with non-life-threatening injuries, officials said. No arrests were made or charges filed, pending the official investigation. Our thoughts and prayers are with the critically injured bicyclist. We wish him the very best for a speedy and complete recovery.
Bicycle accidents involving delivery workers in New York City have become a significant public safety issue as app-based delivery work continues to grow. Delivery workers, many of whom rely on bicycles, e-bikes and mopeds, spend long hours navigating dense traffic, narrow bike lanes and streets that are often blocked by vehicles. This constant exposure increases the likelihood of collisions, whether with motor vehicles or with other road users. Studies and delivery worker testimonies highlight that dooring accidents, drivers encroaching into bike lanes and poor road conditions are among the most common causes of these bicycle accidents. Pressure from employers to complete deliveries quickly can also contribute to risky situations.
The injuries suffered by victims in such bicycle accidents can be severe. Delivery workers suffer high rates of catastrophic injuries and fatalities. Because many delivery workers are immigrants or independent contractors without workers’ compensation, an injury can lead to lost income and limited access to medical care. Advocacy groups have pushed for stronger infrastructure, clearer regulations for micromobility and improved worker protections.
Compensation and the value of a bicycle accident case will depend on the nature and extent of the injuries sustained by the victim as well as the extent of negligence (carelessness) on the part of the driver. In such cases, negligent (careless) motorists or passengers can be held responsible for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitative treatment, permanent injuries, disabilities, past and future pain and suffering, etc.
In cases of serious injury, the bicyclist may be entitled to compensation for future medical care and a loss of earning capacity and permanent injuries, etc. Pain and suffering, emotional distress, and diminished quality of life, etc. can also be factors in calculating compensation. Families of deceased victims can also seek compensation for their losses by filing a wrongful death claim.
