Bayer’s $10 Billion Roundup Settlement to Also Benefit Research

Bayer, the pharmaceutical company that makes Roundup weed killer, entered into a settlement last week agreeing to pay about $10 billion to settle legal claims over the health effects of the herbicide. According to a report in Discover Magazine, the settlement will bring an end to 95,000 lawsuits brought against Monsanto, which Bayer bought in 2018.

Furthermore, the settlement will allocate $1.25 billion for independent research into whether Roundup causes non-Hodgkin’s lymphoma and at what doses the risk becomes higher. The money is a step in the right direction, according to researchers who have done studies in the past about whether glyphosate, the active ingredient in Roundup, causes cancer. Earlier research has found the chemical to be potentially dangerous for human health. With this settlement, there is an acknowledgement of the need for more independent research into the issue as well as coming to a consensus regarding the findings.

So far, very little is known about what health risks Roundup poses for human beings. Monsanto, and now Bayer, face thousands of lawsuits from people claiming that use of this herbicide led them to develop cancer, predominantly non-Hodgkin’s lymphoma. Most of these lawsuits focus on glyphosate. For famers and landscapers, this is a useful product because it kills weeds. Once the plants absorb the chemical, it gets into the weeds and shuts down their growth. Exposure to Roundup occurs when you breathe in glyphosate through your nose or mouth; when we eat food treated or contaminated with glyphosate; or when we absorb the chemical through our skin.

Studying the Cancer Link

In 1996, Monsanto introduced Roundup-Ready seeds, which were genetically modified to withstand Roundup treatment. There have been red flags along the way. In 2015, the World Health Organization (WHO) announced that glyphosate is “probably carcinogenic” to humans. Despite the widespread use of glyphosate and the controversy regarding the chemical, the extent of research about its effect on the human body is quite limited.

Last year, one study, which looked at six previous studies about glyphosate, determined that exposure to this herbicide did make people more susceptible to cancer. They also determined that the more pesticide people were exposed to, the higher the risk. While many of these studies focused on agriculture workers, there is hardly any independent research that has assessed the health risks to the general population or people who come into contact with glyphosate products, especially through food consumption.

For example, grocery shoppers may have seasonal exposures to the chemical during periods when they are consuming fruits and vegetables. Researchers agree that there is a requirement for more studies to be done here. Most of the research relating to human health and glyphosate has focused on non-Hodgkin’s lymphoma, which is a cancer that originates in the white blood cells. Researchers are calling for a study that will explore the connections between glyphosate and all types of cancers.

Contacting an Experienced Lawyer

A victim who has been diagnosed with non-Hodgkins lymphoma or other types of cancers as a result of exposure to Roundup weed killer may be able to file a product liability lawsuit against the manufacturer, Bayer (Monsanto), seeking compensation for damages including medical expenses, permanent injuries, lost income and benefits, disabilities, past and future pain and suffering, etc. A family that has lost a loved one as a result of these dangerous and defective products may also be able to file a wrongful death lawsuit against the manufacturer seeking compensation.

If you or a loved one has developed cancer and/or other adverse health effects from using products containing glyphosate, the experienced New York personal injury attorneys at the Law Offices of Kenneth A. Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you.

Our firm recovered $1,162,500 for a child who suffered lead poisoning from paint in her apartment. The child’s injuries were subtle and difficult to recognize. We recovered $162,500 above the $1 million dollar total insurance policy in this case. Despite the judge’s efforts to settle the case for $950,000, we fought hard and recovered $162,500 more than the insurance policy of one million dollars. Also, one of our clients obtained a verdict for $43,940,000 and another of our clients got a verdict for $23,500,000, both in medical malpractice cases.
