Supreme Court Rules Cancer Patient Can Sue for Distress over Misdiagnosis

We seek the advice and guidance of doctors with the hope that they will properly diagnose our illnesses and prescribe the required treatment. In certain instances, patients find themselves in situations where their doctor may have failed to diagnose a serious condition, or misdiagnosed their condition, or even diagnosed the condition late and after a long period of time. All these medical errors can have catastrophic consequences for patients. When a diagnosis is incorrect or delayed, there is a definite chance for the patient to suffer injuries or death. There is also the danger of taking the wrong type of medication or receiving the wrong treatment, which could prove injurious to the patient.

Recently, the Ohio Supreme Court ruled that a cancer patient may pursue an emotional distress claim that alleges that a misdiagnosis allowed an undetected cancer to spread in the patient’s body. According to an Associated Press report, the lawsuit that was filed as part of a medical malpractice lawsuit, seeks damages from a radiology service and a doctor. The court determined that the claim may be pursued because it is based on physical injuries.

There is no question that cancer misdiagnosis can have serious physical and emotional effects on not only the patient, but also his or her family. Patients injured as a result of cancer misdiagnosis can seek monetary damages for all medical expenses as well as non-economic damages for pain and suffering, and emotional trauma, and loss of earnings, etc.
