Child Fatally Hit by Truck while Riding his Tricycle

A 4-year-old boy was killed in a Brooklyn car accident when the tricycle he was riding was hit by a truck. According to a report in The New York Daily News, the fatal truck accident occurred on Heyward Street near Harrison Avenue in Brooklyn the evening of May 12, 2011. The Arnold’s meat truck pulled out of a parking lot and struck the boy. The young victim was caught under the truck and dragged for about 200 feet before the truck came to a stop. The child died at the scene of the crash. An investigation is ongoing.

Drivers pulling out of private driveways and parking lots must yield right-of-way to vehicles on the roadway and to individuals utilizing the sidewalk. New York Vehicle and Traffic Code Article 26 (1143) states: “The driver of a vehicle about to enter or cross a roadway from any place other than another roadway shall yield the right of way to all vehicles approaching on the roadway to be entered or crossed.”

A driver does not, however, need to be cited by the authorities to be held civilly liable for their negligence. To hold at-fault motorists liable for a fatal collision, the victim’s family may file a wrongful death claim. In such cases, compensation may be available for losses including lost income of the deceased, medical expenses, funeral expenses, pain and suffering, loss of inheritance, and many other losses. If a commercial truck driver is determined to have been at fault, the driver and his or her employer could be held liable for the personal injuries or wrongful death caused.
