There was a total of 16,357 accidents involving pedestrians in New York State, according to the Department of Motor Vehicle’s 2010 statistics. In those traffic accidents, 309 people were killed and 16,023 were injured. Also during the same year, of those pedestrians who were injured, 1,898 suffered serious injuries, 3,000 sustained moderate injuries and 9,498 suffered minor injuries.
Pedestrian Accident Causes
Pedestrian accidents often result in major injuries or even fatalities. There are several reasons why pedestrian accidents may occur. Motorists may fail to yield the right-of-way to pedestrians who are walking in crosswalks. Pedestrian accidents frequently occur due to driver distraction, inattention, impairment, etc. Drivers who are backing up are required to ensure that no pedestrians or vehicles are behind them.
When such an accident occurs, there are a number of questions that must be asked. Was the driver inattentive or distracted? Was the driver’s view hampered? Did the vehicle lack safety devices? Was there a dangerous condition on the roadway? In cases where negligence is involved, the at-fault driver, the vehicle owner and his or her employer can be held liable for the victim’s wrongful death. Victims’ families can seek compensation for damages including, but not limited to, lost future income and benefits, medical expenses, funeral costs, pain and suffering, etc.
