A Bronx man suffered serious head injuries after a tractor-trailer struck him. According to a news report on NJ.com, the major injury truck accident occurred as the man was crossing Huyler Street at the intersection of Chippewa Court in Teterboro, New Jersey. A FedEx trailer hit the pedestrian. The man sustained major head trauma and was rushed to a local hospital. He was listed in critical but stable condition. The 62-year-old driver of the tractor-trailer told police that he failed to see the pedestrian as he crossed the street in the dim morning light. No summons has been issued. The investigation is still ongoing.
Pedestrian Accidents in New York State
According to the New York Department of Motor Vehicles, 16,537 pedestrian accidents were reported statewide in 2010. These pedestrian accidents resulted in 309 fatalities and 16,023 injuries. Of those injuries, 1,898 were serious, 3,000 were moderate and 9,498 were considered to be minor.
Collisions Involving Large Trucks
Pedestrian accidents, particularly those involving large trucks, are extremely common at street intersections where a truck driver’s visibility may be limited. Truck drivers are still required to slow down and proceed with caution at street intersections and crosswalks where pedestrians may be present. There are several questions that must be asked in such cases. Who was at fault? Was there a dangerous condition at the roadway or intersection such as poor design or inadequate lighting? Was the truck driver inattentive, distracted or fatigued at the time? Was excessive speed a factor?
Compensation for Truck Accident Victims
In such cases, injured victims can seek compensation for damages from the truck driver as well as his or her employer. If a dangerous roadway caused the accident, the city or governmental agency responsible for the maintenance of the roadway may be held liable as well. Injured victims can seek compensation for damages including medical expenses, lost wages and benefits, cost of hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc.
