Woman Killed in Queens Hit-and-Run Bicycle Accident

Hit-and-Run Bicycle Accident AttorneyAmanda Servedio, 36, was killed in a hit and run bicycle accident in Astoria, Queens, after she was struck by a vehicle at the intersection of 37th and 34th avenues. According to a CBS New York news report, surveillance video shows Servedio trying to ride through the intersection when a black pickup truck struck her and ran her over. Officials say the truck was fleeing a burglary scene. Police are still looking for the three suspects who were in the vehicle.

Ongoing Investigation

The burglary was reported on Crescent Street, less than a mile away from the scene of the crash. Police stopped the truck that had duct tape covering the license plate. Instead of talking to police, the suspects drove off hitting two other responding police cruisers. The officers suffered neck and back injuries. Police pursued the truck, which hit the bicyclist minutes later.

Police also said the truck involved has a total of 90 violations dating back to 2022 including school zone and red-light violations. Police are still looking for the vehicle’s owner. The vehicle, they say, has not been reported stolen. Anyone who may have information about the truck or the suspects is asked to contact NYPD’s Crime Stoppers hotline at 1-800-577-TIPS (8477). We offer our deepest condolences to the family of Amanda Servedio for their tragic loss.

Leaving the Scene of an Accident

In New York, leaving the scene of a crash is a serious offense with significant legal consequences. According to New York Vehicle and Traffic Law Sections 600(1) and 600(2), drivers involved in an accident that resulted in property damage or personal injury are legally obligated to stop, exchange information, and, if necessary, render assistance.

Failure to do so is considered “leaving the scene of an accident” and can result in criminal charges, which can vary in severity based on the circumstances. A hit-and-run involving serious injury or death can result in felony charges, carrying penalties that include substantial fines, imprisonment and loss of driving privileges.

Injuries and Compensation

Injured victims of bicycle accidents and pedestrian accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused.

Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.
