Slip and Fall AccidentA woman has filed a lawsuit against McDonalds after suffering an injury in a slip-and-fall accident at one of their restaurants. According to a recent news report the slip-and-fall lawsuit states that there was water on the floor of the restaurant but no wet floor signs were posted at the time of the accident. The victim is seeking compensation for multiple losses including medical expenses, mental anguish, physical pain, disfigurement, lost wages, impairment, and court costs. In addition to naming R.E.E. Inc in the lawsuit, the victim also included the facilities manager for failing to prevent the injury accident.
Slip-and-fall accidents have the potential to do great harm because the victim often lands unexpectedly, suddenly and violently on hard surfaces such as hardwood floors, tile or cement. Common injuries suffered in New York slip-and-fall accidents include broken hips, fractured skulls, herniated or slipped discs, sprained wrists and ankles, broken scapulas, neck strains, and brain injuries. It is the legal obligation of all property owners and managers to help prevent slip-and-fall accidents by providing safe conditions. When an area is wet, it is the property owner and manager’s obligation to post warning signs that alert visitors about hazardous conditions.
Victims of slip-and-fall accidents would be well advised to notify the property manager of the accident and to seek immediate medical attention. If the property owner fails to offer fair compensation for the injuries suffered, the victim may have to file a civil lawsuit with the help of a premises liability attorney. Compensation should be available for losses including, but not limited to medical bills, lost wages and benefits, rehabilitative treatment, and past and future pain and suffering.
