A 56-year-old woman and her 8-year-old grandson were injured in a pedestrian accident after they were struck by a car while crossing a street in Queens. According to a report in the New York Post, the woman and the boy were crossing the street near Jamaica Avenue and 115th Street in Richmond Hill the morning of Aug. 3 when a pickup truck that was making a left turn hit them. Both the woman and her grandson were said to have been walking in a crosswalk at the time.
An eyewitness said the child and the woman were pinned under the vehicle. The woman was rushed to an area hospital in critical condition. The boy who was bleeding from his face was also transported to an area hospital where he was listed in stable condition. It’s not clear if the driver who remained at the scene will be charged. The investigation is ongoing.
Failure to Yield
New York Police Department’s data shows that as of May 2019, 65 people died in traffic accidents this year, a number that is up from 50 during the same time in 2018. Nationally, pedestrian accidents are at an all-time high as well. But, when it comes to pedestrian accidents in New York City, one of the most common causes is failure on the part of motorists to yield the right of way to pedestrians who are walking in crosswalks or are crossing at a street intersection.
Under New York City laws, motorists are required to stop and yield the right of way to pedestrians walking in a crosswalk. It is important to remember that drivers have to exercise caution around pedestrians even when they are not in crosswalks.
Based on this news report, it appears that the driver of the pickup truck was attempting a left turn at the intersection when he struck the pedestrians who were in the marked crosswalk. In such cases, law enforcement officials typically look at a variety of factors that may have potentially contributed to the pedestrian accident including but not limited to impaired driving, distracted driving, a medical condition, drowsy driving, etc.
Injuries and Compensation
In such accidents, the odds of the pedestrian suffering catastrophic or fatal injuries are much higher. This is because pedestrians have no protection when hit by a vehicle. Victims face major, life-threatening injuries such as brain trauma, spinal cord damage, internal injuries, etc. Pedestrian accident injuries often lead to victims requiring extensive treatment and rehabilitation. Some victims are unable to function normally for a long time after the accident and are even unable to return to their jobs, leaving them and their families financially devastated.
Victims who have been injured in New York City pedestrian accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families of deceased pedestrian accident victims may be able to file a wrongful death lawsuit seeking compensation for damages such as lost future income, funeral costs, medical expenses, pain and suffering, etc.
