$2,000,000 – Hit and Run Accident

Posted in and tagged by Kenneth A. Wilhelm, Esq.

Our client, a 6-year-old child, was struck by a car near her home in Brooklyn. The driver of the car did not stop and fled the scene of the accident. A witness identified the car and the child’s mother sued both the owner of the car and the driver. While the driver claimed that he was picking up his co-worker at John F. Kennedy Airport at the time of the accident, our firm was able to produce a videotape that timed a car using the same route that the driver claimed to be on. The videotape showed that the driver would have had time to be at the scene of the accident at the alleged time.
In this case of hit and run it was originally dismissed by the judge during trial which means our client would get nothing.  However, we aggressively appealed the judges decision and had it overturned.  We then retried the case during which it was settled for $2,000,000.
