Two Train Derailments in 11 Days at Penn Station

A train accident at New York City’s Penn Station the morning of April 3 caused several delays for commuters, but did not result in any major injuries. According to an NBC New York news report, the incident that occurred at the height of the morning rush, was the second train derailment in less than two weeks at Penn Station. A spokesperson for NJ Transit said Monday’s incident was a “slow-speed derailment” as the train out of Trenton pulled into Track 9. Commuters in the last four cars had to escorted off the train. Officials said four of the 1,200 passengers on board suffered non-life-threatening injuries.

FDNY officials said they treated five people and all were expected to recover from their injuries. Passengers said they felt a jolt right before the train reached the platform. One Twitter user said “total panic” erupted and another said her husband who was in one of the derailed cars reported that both exit vestibules were crushed. The accident is under investigation. Amtrak, which owns the tracks, is also evaluating the situation. On March 24, an Amtrak Acela slipped off the tracks and bumped an NJ Transit train heading in the opposite direction. No one was injured in that train accident.
Steps to Take After a Train Accident
The aftermath of a train accident or derailment can be extremely chaotic as we can gather here from many of the tweets sent out by hundreds of passengers. If you have been involved in a similar incident, it is important to get medical attention right away. The primary purpose of going to the doctor is to determine if you have suffered injuries. It would be in your best interest to pay a visit to the hospital even if you have not suffered apparent injuries. The symptoms of many injuries typically sustained in a train accident such as whiplash may not surface until days after the incident. You may also not feel any pain or effects because of the shock or trauma that you’ve just endured as a result of the incident.
If possible, talk to investigators at the scene and ensure your name is recorded on their report. Also, be sure to obtain a copy of that report. Take photographs of the accident scene. Talk to anyone who may have seen you get injured. Save your train ticket. Keep track of the number of workdays you have missed because of your injuries as well as the recovery time. Save all receipts relating to the incident including bills for emergency transportation, hospitalization, doctor office visits, medication, medical equipment, physical therapist visits and so on.
Maintain a journal of your experiences immediately after the incident and in the days and weeks that follow as you recover. Write down what you can or cannot do as a result of your injuries. Also, document your state of mind such as experiencing depression or helplessness. Immediately contact an experienced train accident lawyer who will stay abreast of what may be a lengthy investigation and guide and assist you through the complex claims process.
Injuries and Damages
Train accidents may result in serious injuries. It is indeed fortunate that this particular derailment did not cause any major injuries. However, in many such incidents, passengers tend to get thrown around and ejected from their seats. As a result they may suffer head injuries, neck and back trauma, broken bones, internal injuries, etc. Some of these injuries may result in chronic pain and require extensive rehabilitation including physical therapy, which may prove costly.
A victim who has been injured in a train accident may be able to seek compensation from one or more parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc.
