Two people who were crossing a street on the Upper West Side were severely injured in a pedestrian accident when, officials said, a motorist blew through a red light and struck them. According to a report in the New York Daily News, which examined surveillance video, a man and woman stepped into the crosswalk at West 98th Street and West End Avenue after the light overhead changed to red the afternoon of July 19. The report said a grey vehicle headed north on West End Avenue ran the red light and crashed into the two pedestrians sending their bodies flying in the air.
A neighbor said he heard a bang and a scream and saw the two victims lying in the street, motionless. The victims landed about 25 feet from the point of impact, witnesses said. The woman who was driving the car stopped and remained at the scene. She’s yet to be charged, according to police.
The victims were described as a doorman in his 50s who works close by and a 65-year-old woman. Both were rushed to an area hospital with head trauma, and were said to be in serious but stable condition. Our thoughts and prayers are with these two injured victims. We wish them the very best for a quick and full recovery.
Common Causes of Crosswalk Accidents
Based on this news report, it appears that both pedestrians were walking in a marked crosswalk when they were struck and severely injured. Under New York law, motorists are required to come to a full stop at a crosswalk and yield the right of way to pedestrians. However, we see that a number of crosswalk accidents in New York City involve drivers who fail to yield the right of way to pedestrians. Some of the most common causes of crosswalk accidents include driving at an excessive speed, driving while distracted, operating a vehicle while intoxicated and failing to pay attention to one’s surroundings. Most of these causes fall under the category of negligence (carelessness) or wrongdoing.
Victims who have been injured in New York City pedestrian accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families of deceased pedestrian accident victims may be able to file a wrongful death lawsuit seeking compensation for damages such as lost future income, funeral costs, medical expenses, pain and suffering, etc. Pedestrian accidents often result in major or catastrophic injuries such as head trauma, spinal cord damage, broken bones, internal organ damage, etc.
Please remember that you can file a personal injury lawsuit even if you were not walking in a crosswalk at the time of the collision. Our law firm has secured substantial compensation for pedestrians who were not walking in a crosswalk when their injury crash occurred. We have recovered millions of dollars for pedestrians who were not in crosswalks.
