A 2-year-old girl remains in critical condition after falling from a window at Midwood home last month. According to a news12 report, police officers responded to a 911 call at a home on East Second Street the morning of June 15 at a home on East Second Street. The victim was taken to Maimonides Medical Center, where she was in critical condition, officials said. The investigation into what led to the fall is ongoing. It is not clear if the window had guards.
This incident comes as health officials in New York City are reminding families to take extra precautions around open windows, particularly in the warmer months. In May, a 3-year-old girl was rushed to Cohen Children’s Medical Center after falling from a window at a Queens building. In that case, the child fell off a second-floor window at a building near Myrtle Avenue and 64th Street in the Glendale section. She was reportedly in stable condition. It is not known if that window had guards either.
NYC Laws Regarding Window Guards
New York City has some of the nation’s strictest window guard requirements to prevent such horrific accidents. Under New York City law, property owners/managers must install and maintain approved window guards in apartments where a child 10 years of age or younger resides, or where a tenant requests them. In most multi-unit residential buildings, building owners are also required to provide annual notices asking tenants whether young children live in the apartment and must install window guards in common areas when required by law. When property owners/managers fail to do so, they can be held liable for an accident and injuries that occur as a result.
Property owners/managers have an ongoing duty to ensure that window guards are properly installed, securely maintained and compliant with the city’s safety regulations.
