The number of lawsuits alleging that Bayer AG’s Roundup weed killer causes cancer has more than doubled over the past three months to 42,700, a number that has increased from 18,400 in July. According to a report in Fortune.com, Bayer paid $63 billion last year to acquire Monsanto thereby acquiring Roundup and other weed killers as part of that deal. So far, three U.S. juries have ruled against Bayer in cases brought by Americans alleging that Monsanto’s popular herbicide caused their cancer.
Lawsuits and Controversy
Bayer has maintained its products are safe. However, studies say otherwise. In 2015, a World Health Organization body found that glyphosate, the active ingredient in Roundup weed killer, may cause cancer in humans. The state of California has also listed glyphosate as a substance known to cause cancer.
The first lawsuit to go to trial in California alleging glyphosate causes cancer resulted in a $289 million verdict for the plaintiff, a groundskeeper who regularly used Roundup and alleged that it caused him to develop non-Hodgkin’s lymphoma – a form of cancer. That award was later reduced to $78 million. In 2017, the European Union narrowly approved the use of glyphosate for another five years but Austria has since moved to ban the chemical and Germany has said it will ban glyphosate at the end of 2023.
What is Glyphosate?
Glyphosate is a popular herbicide used to kill certain plants and grasses. It is also used to manage plant growth, get crops ready for harvest and ripen fruit. Glyphosate is the active ingredient in popular weed-control products such as Roundup. It is often used on fruit and vegetable crops as well as lawns, greenhouses and aquatic plants. Glyphosate comes with a lot of health risks. Some studies suggest glyphosate is linked to cancer.
The International Agency for Research on Cancer also categorizes glyphosate as a probable carcinogen for humans. Studies of dairy cows showed that glyphosate may affect the kidney and liver. It may also cause problems with the endocrine system and has been linked to developmental and reproductive issues. Some scientists are concerned that pregnant women and children may have higher risks because children and developing fetuses are more susceptible to carcinogens.
A broad new scientific analysis of the cancer-causing potential of Roundup and herbicides containing glyphosate has found that people with high exposure to these herbicides have a 41 percent increase risk of developing non-Hodgkin’s lymphoma. The evidence supports a compelling link between exposure to glyphosate and this particular type of cancer, according to findings by five U.S. scientists.
Compensation for Affected Victims
A victim who has been diagnosed with non-Hodgkins lymphoma or other types of cancers as a result of exposure to Roundup weed killer may be able to file a product liability lawsuit against the manufacturer, Bayer (Monsanto), seeking compensation for damages including medical expenses, permanent injuries, lost income and benefits, disabilities, past and future pain and suffering, etc. A family that has lost a loved one as a result of these dangerous and defective products may also be able to file a wrongful death lawsuit against the manufacturer seeking compensation.
