Pedestrian Killed, NYPD Officer Injured in Separate Hit and Run Crashes

Officer Injured in Separate Hit and Run Crashes

Dilmania Lopez de Rodriguez, 32, was fatally injured in a pedestrian accident in the Bronx, which officials say, involved a hit-and-run driver on Aug. 26. An NYPD officer was injured after he was struck by a hit-and-run driver while directing traffic in Brooklyn the night of Aug. 31. According to a WABC news report, the Aug. 26 fatal pedestrian accident occurred when a driver traveling north on Bruckner Boulevard struck Lopez de Rodriguez who was in the crosswalk at Leggett Avenue.

Two Incidents Involving Hit-and-Run Motorists

Based on the news account, the pedestrian was hit by a truck that was making a turn. The victim was discovered lying in the roadway and taken to Lincoln Hospital where she was pronounced dead. The driver did not stop and left the scene of the fatal collision. Lopez de Rodriguez, a 32-year-old wife and mother, was on her way home from work, family members said. No arrests have been made and the investigation is ongoing. We offer our deepest condolences to Lopez de Rodriguez’s family members for their tremendous loss.

In the Aug. 31 incident, an NYPD sergeant was directing traffic at Schenectady and Church Avenues in East Flatbush when he was struck by a vehicle, which also left the scene. The officer was transported to Kings County Hospital in stable condition. Police are searching for the driver of the vehicle. No arrests have been made so far, and the investigation is ongoing. Our thoughts and prayers are with the injured police officer and we wish him the very best for a quick and full recovery.

Compensation for a Hit-and-Run Collision

In New York City, a hit-and-run is a serious criminal offense under both state and city law. A hit-and-run occurs when a driver involved in a motor vehicle accident leaves the scene without stopping to provide contact information, assist injured parties or report the incident to law enforcement. Under New York Vehicle and Traffic Law Section 600, leaving the scene of an accident without reporting it can result in misdemeanor or felony charges, depending on the severity of the incident. Drivers are legally obligated to stop immediately, exchange information, and call the police if necessary.

In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable. When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused.

Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. You should consult a personal injury lawyer immediately to protect your rights.
