Pedestrian Injured in Kips Bay SUV Accident

A woman was severely injured in a collision with an SUV in Kips Bay. According to a DNAinfo.com report, both, the NYPD and the FDNY responded to the scene of the accident at Third Avenue near East 30th Street. FDNY officials stated that the victim was walking on the avenue shortly after noon when the SUV struck her. Officials, who did not release the identity of the woman, said she had suffered serious head injuries due to the collision.

Witnesses rushed to the accident site and tried to help and comfort the victim. One witness said that the pedestrian was on the ground on her left side, bleeding from her arm and appeared to be frightened, based on the news article. Officials placed the victim in a neck brace and a board before transporting her to a nearby hospital. The woman has since been listed in serious condition with injuries to her head. Our best wishes to this pedestrian accident victim for a quick recovery.
Pedestrian Accidents and Driver Responsibilities
Pedestrians who are walking in a marked crosswalk have the right of way, under Section 1111 of the New York Vehicle and Traffic Law. A motorist owes others, including pedestrians who are sharing the roadway, a duty to exercise reasonable care while operating his or her vehicle. The driver is required to stop the vehicle and yield the right of way and allow pedestrians to cross the roadway, before moving ahead, even where traffic control devices are not available or not functioning. Further, a driver may still be held liable when the accident involves a pedestrian who has been struck while he or she was outside a crosswalk, or sidewalk or in an area not designated for pedestrians.
Many street intersection accidents that involve a pedestrian being struck by a vehicle or even a bicycle occur due to a number of factors. These include driver error or negligence – inattention and failure to yield, impaired driving, distracted driving, and/or speeding. In these types of collisions, the pedestrians tend to suffer serious injuries such as head injury, spinal cord trauma, broken bones, amputations and internal organ damage or even death.
Pedestrian Accident Head Injuries
We have seen that in many vehicle versus pedestrian accidents, the faster the rate of travel of the vehicle, the greater the injury to the victim. The force of the heavier vehicle hitting the victim may launch him or her into the air and cause them to hit their head against the vehicle’s windshield and/or the pavement leading to head and/or brain trauma.
A head injury is unlike other injuries say for example, a fractured bone or an internal puncture wound, in that it has an impact on the physical, emotional, behavioral and cognitive state of the victim. Brain injuries or head injuries can be catastrophic and result in long-term or even permanent disabilities. In such cases, the victims and their families typically face enormous physical, emotional and financial challenges that may affect their lives on a daily basis.
Compensation for Victims
Pedestrian accident victims may be able to seek compensation for the injuries, damages and losses they have sustained. Injured victims can seek compensation for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. A skilled pedestrian accident lawyer can help evaluate the nature and extent of the damages as well as identify the liable parties. The value or worth of your case will depend on the nature and extent of your injuries and the degree of liability of the other parties involved.
