Pedestrian Fatally Injured in East Harlem

Pedestrian accident attorneyPeter Roberts, 53, was killed in a pedestrian accident in East Harlem. According to Streetsblog.org, the fatal collision occurred on East 125th Street the morning of May 24 when Roberts attempted to cross the street heading north. A flatbed truck then hit him. Roberts was struck by one of the truck’s front wheels and dragged for several hundred feet before onlookers alerted the driver that he had hit the victim, an NYPD spokesperson said.

The 38-year-old driver remained at the scene and was not arrested. A police department representative told Streetsblog that there was “no suspected criminality.” Footage from the scene shows first responders attempting to free the victim from under the truck. We offer our deepest condolences to the family members of Peter Roberts for their tremendous loss. They will be in our thoughts and prayers.

Dangerous Roadways and Intersections

The stretch of 125th Street has long been dangerous, the news outlet reports. Over the past 12 months, there have been 310 crashes on the thoroughfare that have injured 176 people including 41 pedestrians and 28 bicyclists. In just the one block where this fatal crash occurred, there have been 21 major injury collisions over the past year, which amounts to almost two per month, injuring seven people including three pedestrians and one bicyclist.

The four-lane roadway has no marked pedestrian crossings between the avenues on the long block creating a very dangerous situation for those who need to cross the roadway, according to the news report. This year, traffic deaths in the city have remained above pre-pandemic levels, at 84 deaths through May 23, up from 77 during that same period in 2019, according to the New York City Department of Transportation. This year, 35 pedestrians were killed citywide, down from 41 in 2022 and 45 in 2019. However, bicyclist deaths have surged this year to 13, the highest number in a decade.

Injuries and Damages

Pedestrian accidents have the potential to cause major or even catastrophic injuries such as traumatic brain injuries, spinal cord damage, broken bones and internal injuries. They can also prove fatal as in the case of this tragic incident. Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as medical and funeral costs, pain and suffering, lost future income, etc.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
