A Brooklyn man who sustained major injuries in a pedestrian accident on Nov. 9 has died from his injuries. According to a report on Streetsblog.org, the 39-year-old man was crossing Eastern Parkway from south to north inside the crosswalk with the light when a driver turning left from Bushwick Avenue struck him, knocking the victim to the pavement and causing severe head trauma.
Tragic Pedestrian Accident
The man was transported to an area hospital. He died from his injuries on Nov. 19, 10 days after the accident. The driver of the four-door sedan didn’t stop and kept going, police said. Streetsblog.org reports that the section of Bushwick Avenue where this pedestrian collision happened is a busy and dangerous stretch of roadway with many car dealerships and other facilities.
The site further reports that in the 10-block stretch between the Jackie Robinson Parkway exit ramp and Chauncey Street, there were 252 total crashes reported in 2019 injuring three bicyclists, two pedestrians and 70 motorists. Also, in 2020, police said they caught only 0.8% of hit-and-run drivers in 39,299 crashes. While a vast majority of those crashes are limited to property damages, police still solved only 278 out of 6,032 injury hit-and-run crashes in 2020, which amounts to 4.6% of total cases.
A number of pedestrian accidents occur because negligent (careless) motorists fail to yield the right of way to pedestrians particularly at crosswalks and street intersections. Under New York’s traffic laws, all drivers are required to come to a full stop at a crosswalk, wait until pedestrians cross the road and then drive only when it’s safe to do so. However, in New York City, it is unfortunately common to see motorists frequently violate this law putting pedestrians in grave danger. A number of major injury or fatal pedestrian, bicycle and car accidents across the city have also been caused by speeding drivers, particularly during the coronavirus pandemic when such crashes have exponentially increased.
Liability Issues
When these types of accidents are caused by drivers’ negligence (carelessness) — examples of which include impaired driving, distracted driving, and failing to yield the right of way to a pedestrian in a crosswalk, the victims can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.
Contacting an Experienced Lawyer
If you or a loved one has been injured in a pedestrian accident, or if you have lost a loved one in an auto accident caused by a negligent (careless) driver, the experienced New York personal injury attorneys at the Law Offices of Kenneth A. Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you.
If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household. Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
For 50 years, our skilled accident attorneys have established a proven track record of helping injured victims get fair compensation for their losses.
