A 47-year-old man has been critically injured in a Brooklyn pedestrian accident, which officials say, was caused by a hit and run driver. According to a CBS New York news report, the incident occurred the morning of Sept. 22 on Conduit Boulevard in the Cypress Hills section of the borough. Witnesses say the victim was not using the crosswalk as he was crossing the street. A car struck him and the impact threw the man on a tree nearby, witnesses said. The driver never stopped.
Legislator Calls for Stronger Investigations
City Councilman Ydanis Rodriguez came to the crash site to call for stronger hit-and-run laws. He said this is a crime that has become all too common in New York City, adding that 2019 is the worst year the city has seen since starting the Vision Zero program, which aims to bring traffic accidents to zero in the city.
Rodriguez said he wants the city to design safety intersections and wants the New York Police Department to double the number of officers investigating hit-and-run collisions. He says there is a lack of resources to investigate and prosecute drivers who leave the scene of a crash. Police described the vehicle they are looking for in this case as a dark-colored Nissan SUV. The city’s Transportation Committee is set to hold a hearing next week to tackle ways to improve Vision Zero.
The most worrying trend is the sharp spike in the number of pedestrians and bicyclists in New York City who have been killed by hit-and-run drivers. This statistic has jumped by 34 percent between 2013 and 2016. And drivers seem to be getting away with it. Bicycle accidents have also seen a significant increase this year compared to 2018.
Compensation for Victims
In a hit-and-run accident, victims and their families are often left with not just questions about how to hold the driver accountable, but with mounting medical bills and other expenses. Hit-and-run accidents have increased with alarming frequency in New York City. While there has been some decline overall in traffic accident fatalities over the last few years, that hasn’t been the case for pedestrians and bicyclists.
If a hit-and-run driver has injured you, you can seek compensation through the uninsured motorist clause of your auto insurance policy even though the driver has not been identified or through a quasi-state agency if there is no motor vehicle in the victim’s household. It is important to remember that in cases where the injured victims are pedestrians, they will be able to seek compensation for injuries or losses in a collision even if they were not walking in a marked crosswalk.
A family who has lost a loved one in a hit-and-run crash may be able to file a wrongful death lawsuit seeking compensation as well. It is crucial that you retain the services of an experienced motor vehicle accident lawyer immediately in these situations, because these are tricky and complex cases with a number of pitfalls. If you have been injured, it is important that you take a number of steps including filing a police report, gathering evidence from the scene and getting prompt medical attention, etc. You should also contact an experienced New York City hit-and-run lawyer promptly.
