NBC’s I-Team recently analyzed more than 400,000 elevator inspections conducted between 2017 and 2019 and found 2,217 instances where elevators were given “satisfactory” or “no violation” ratings by private inspectors, only to attract violations issued by the NYC Department of Buildings in the next 90 days. Under city law, every passenger elevator in New York City is required to undergo two annual inspections.
This report shows that in thousands of cases, elevators pass inspections only to be tagged with city-issued violations in the days and months immediately after. Last August, a 30-year-old man was crushed to death when an elevator in the Manhattan Promenade malfunctioned. The fatal elevator accident occurred just three weeks after the elevator passed an inspection.
Concern Over Private Inspections
New York City’s nearly 70,000 elevators are subject to two annual inspections per year. One of those inspections is usually conducted by a private contractor that the Department of Buildings hires. Another inspection is conducted by a private company hired by the building owner. A third type of inspection takes place when a tenant calls 311 to complain about a malfunctioning elevator. In those cases, city building inspectors are sent out to examine the elevator.
NBC’s I-Team compared the conclusions of those inspectors with results of the most recent private inspections. In some cases, the team found city inspectors issuing violations just days or weeks after private companies gave the elevators passing grades. For example, an elevator inside 137 W. 141st Street in Harlem was slapped with seven violations in 2017. In October, a private company hired by the landlord (building owner) gave the elevator a passing grade. Last year, the New York State Comptroller released an audit of the city’s private elevator inspection process that concluded the elevator inspections are not properly done. As a result, the report said, unsafe conditions are not always identified and fixed right away. The audit also found inspectors employed by two companies operating under city contracts were routinely missing safety problems and even failed to document more than 14,000 required elevator inspections over a two-year period.
Who is Liable?
