A driver trying to park a minivan in Manhattan’s Chinatown careened over a curb and onto a sidewalk killing a 56-year-old man and injuring six others. According to a report in The New York Times, the pedestrian accident left at least two of its victims in critical condition, while two others suffered serious but not life threatening injuries. Police and fire officials responded to the corner of Canal and Forsyth streets the night of Nov. 26 soon after the 70-year-old driver had tried to park a minivan.
According to the news article, the man had pushed down on the gas pedal of his vehicle instead of the brakes. The minivan ran over a curb before hitting two fruit carts and plowing into the pedestrians. The driver remained at the scene. He was arrested a day later and charged with seven counts of failure to yield to pedestrians and one count each of failure to exercise due care, unsafe backing of a vehicle and driving on a sidewalk.
The driver and a passenger in the minivan were among those injured, but refused any medical attention at the scene. One eyewitness said the vehicle backed up very quickly. The investigation is still ongoing. Our thoughts and prayers are with the injured victims and the family of the deceased victim.
New York City Pedestrian Accidents
Pedestrian deaths in New York City have dropped significantly over the last few years. However, pedestrian safety continues to be a major issue for the city. According to the New York City Department of Transportation (NYCDOT), 101 pedestrians were killed in traffic accidents in 2017. Hundreds of individuals are seriously injured in pedestrian accidents each year and many more suffer injuries that result in medical expenses.
Drivers who do not yield the right of way are one of the most common reasons for fatal pedestrian accidents in New York City. Pedestrians also suffer severe and traumatic injuries when hit by motorists who fail to yield the right of way to them at crosswalks or intersections. New York law requires a vehicle to come to a complete stop at crosswalks and proceed only when pedestrians have crossed the street, and it is safe.
What to Do If You’ve Been Injured
If you or a loved one has been injured in a pedestrian accident, it is important that you take several steps in order to protect your rights. Get immediate medical attention and treatment. Make sure you file a police report and obtain a copy of the report for your records. Your pedestrian accident lawyer can also obtain this report for you.
Collect as much information as possible from the scene of the crash. This should include names and contact information for everyone involved, insurance details of the driver or drivers involved in the collision, photos and/or videos of the crash scene, and contact information for anyone who may have witnessed the accident.
You should limit your social media activity after your accident. Please do not post anything online because any statements you make or the photos/videos that you post online can be used against you, and may jeopardize your pedestrian accident case. It is also important to remember that you have the right to file a pedestrian accident lawsuit even if you were NOT in a crosswalk at the time of an accident.
