Hit-and-Run A 22-year-old man was killed in a Manhattan car accident after his motorcycle was hit by a driver, who left the scene, and then run over by another driver, who officials say, was under the influence. According to The New York Post, the fatal motorcycle accident occurred on 12th Avenue, near West 46th Street, in Manhattan. The motorcyclist was stopped at a red light when the light turned green and a white Honda rear-ended him. He was thrown from the motorcycle and the driver of the car left the scene of the crash. The victim was then run over by a 22-year-old drunk driver in a 1995 Chevy. The motorcyclist was pronounced dead at a local hospital. Officials are still searching for the driver of the white Honda that initially struck the motorcyclist.
Under New York Vehicle & Traffic Code Article 31: “No person shall operate a motor vehicle while the person’s ability to operate such motor vehicle is impaired by the consumption of alcohol.” According to the 2009 Summary of Alcohol-Related Motor Vehicle Accidents, 361 people were killed and 6,810 were injured in New York crashes.
New York Code – Section 600 requires all motorists to remain at the scene of a crash when someone has been injured. Hit-and-run drivers may be held both, criminally and civilly liable for their actions. Victims and their families may still seek compensation for the damages they have suffered whether or not the hit-and-run driver is found. The family of a victim killed in a New York motorcycle accident may pursue financial compensation for their loss by filing a wrongful death claim. They may also seek compensation from the uninsured motorist provision of their auto insurance policy.
