A 67-year-old woman was seriously injured in a pedestrian accident after being struck by a bicyclist, who officials say, blew through a red light. According to Gothamist.com, the pedestrian was in a crosswalk at West 57th Street between Fifth and Sixth Avenues when the bicyclist hit her. She was rushed to an area hospital with a fractured skull and bleeding in the brain. The woman is said to be in serious but stable condition. The bicyclist remained at the scene. Police said the 40-year-old man was not cited or charged in connection with this incident. The man also told police that his gears and brakes were not working properly.
Accidents involving pedestrians who are struck and injured by bicycles occur frequently in New York City. However, fatalities are rare and the last time a bicyclist struck and killed a pedestrian in the city was in 2014. Also in the five years prior to that, only two pedestrian fatalities involving collisions with bicyclists were reported among the 754 pedestrians killed on city streets
Meanwhile, fatalities on New York City streets involving motor vehicles are up nearly 40 percent in 2019 compared to 2018. In 2018, drivers fatally struck 115 pedestrians and 10 bicyclists. This year, just so far, 64 people have died in traffic collisions, up from 43 during the same time period in 2018.
Laws Relating to Bicyclists and Pedestrians
Based on this news report, it appears that the pedestrian was walking in a marked crosswalk when the bicyclist struck her. New York traffic laws require all vehicles to stop and yield the right of way to pedestrians who are walking in crosswalks. This includes bicyclists. The law also states that bicyclists have the same rights and responsibilities as drivers of other vehicles. This means that they are required under the law to stop and yield to pedestrians.
When a bicycle strikes a pedestrian, the injuries can be extremely severe. As it happened in this particular case, victims may suffer severe traumatic brain injuries such as a skull fracture and bleeding in the brain. Individuals may require surgery and extensive rehabilitation to recover from these types of injuries. Some of the other injuries sustained in these types of incidents include spinal cord trauma that may lead to paralysis, multiple broken bones that may cause permanent injuries and disabilities, and internal organ damage, which may prove fatal.
In such cases, the at-fault party may be held liable for the injuries, damages and losses, even if no criminal charges were filed or citations issued. Plaintiffs in a personal injury case must show that the defendant was negligent or careless while operating a vehicle. A police report, which shows that the defendant violated the rules of the road, for example, may help prove negligence (carelessness). An experienced New York City pedestrian accident lawyer will be able to gather the necessary evidence in such cases to help pedestrian accident victims secure maximum compensation for their losses.
Compensation for Victims
Victims who have been injured in pedestrian accidents may be able to seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. It is important to remember that pedestrian accident victims may be able to seek compensation for injuries or losses in a collision even if they were not walking in a marked crosswalk.
