A 60-year-old man sustained serious injuries in a bicycle accident after a U.S. Postal Service truck struck him while he was riding his bike in North Lindenhurst. According to a news report on Patch.com, the man was crossing Route 109 when the truck traveling southbound on Straight Path attempted to make a left turn onto Route 109 and hit the bicyclist. The victim was transported to a West Islip hospital where he has been listed in serious condition. The driver of the postal truck, a 56-year-old Ridge man, was uninjured. No charges have been filed yet. The Motor Carrier Safety Section conducted a safety check on the postal truck and the investigation is ongoing.
Bicycle Accident Statistics
According to the New York Department of Transportation, 47 people died and 5,791 were injured as a result of bicycle accidents statewide in the year 2014. Among the bicycle accidents that resulted in personal injuries, 551 (9.8 percent) were serious, 1,774 (31.6 percent) were moderate and 2,961 (52.7 percent) were relatively minor. Statistics show that failure to yield the right-of-way to bicyclists was one of the leading causes of bicycle versus vehicle collisions.
Common Causes of Bicycle Accidents
Negligent driving causes a number of major injury or fatal bicycle accidents. The most dangerous types of crashes for bicyclists are those that take place at or near a street intersection. Here are some of the most common scenarios in which bicycle accidents occur in New York City:
• Drivers failing to see bicyclists.
• Motorists turning into the path of bicyclists.
• Drivers rear-ending bicyclists.
• Drivers or passengers opening doors in the path of moving bicyclists.
• Motorists making sudden lane changes without seeing bicyclists.
• Big-rigs or tractor-trailers making turns at intersections and failing to see cyclists.
• Drivers who intrude into bike lanes as a result of impairment, distraction or inattention.
• Motorists failing to yield the right of way to bicyclists at street intersections.
• Drivers failing to notice bicyclists as they enter or exit a driveway or parking lot.
• Motorists striking bicyclists as they back up their vehicles.
Bicycle Accident Injuries
The severity of injuries sustained by victims of a bicycle accident often depends on the nature of the impact, the speed of the vehicles involved. One of the most common types of injuries resulting from a bicycle accident is traumatic brain injury. Head injuries may range from concussions to bleeding in the brain or even death. Spinal cord injuries may also occur as a result of bicycle accidents and as with brain injuries, they may lead to permanent disabilities or death. Some of the common facial injuries that occur as a result of bicycle accidents include eye damage, broken nose or teeth, scarring or fractured jaw. Bicycle accidents may also result in multiple broken bones. These types of injuries typically require extensive treatment and rehabilitation, which may prove extremely costly.
In cases where a driver’s negligence caused a bicycle accident, injured victims can seek compensation from the at-fault driver. In cases where the driver was on the job, injured bicycle accident victims may seek compensation from the at-fault driver’s employer as well. When a bicycle accident is caused by a defective bicycle or bicycle part, the manufacturer of a bicycle or of the defective part may be held accountable. When a bicycle accident occurs as a result of a dangerous condition on private property, victims can file a premises liability claim against the property owner and/or property manager.
Compensation for Injured Victims
Injured victims of bicycle accidents can seek compensation for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. These expenses can add up very quickly and place significant financial burdens not just on the injured victims, but also their family members.
