Man Killed in Queens Pedestrian Accident

A man was fatally injured in a Queens pedestrian accident involving a hit-and-run driver. According to a report on Streetsblog.com, the fatal crash occurred when the man was crossing the exit ramp of the Brooklyn-Queens Expressway at Broadway in a marked crosswalk the night of June 2. That’s when a driver heading up the ramp from the southbound highway struck him, causing severe head and body trauma.

The driver fled on 69th Street, officials said. Emergency personnel took the victim to a local hospital where he died from his injuries. We offer our deepest condolences to the family members of this deceased pedestrian. We will hold them in our thoughts and prayers.

Dangerous Intersection and Roadways

Streetsblog reports that the location of this fatal pedestrian accident occurred is notorious in Woodside because it features exit and entrance ramps to the highway that intersect with residential streets and Broadway. Between Jan. 1, 2018 and Dec. 31, 2021, Streetsblog reports, there were 93 reported crashes just at that intersection – or 23 per year – injuring one cyclist, five pedestrians and 25 motorists.

Over the same period, along the 2-mile stretch of Broadway between Northern and Queens boulevards, there were 1,231collisions, or roughly 300 per year, statistics show. Those crashes injured 114 pedestrians, 54 bicyclists and 219 motorists and killed two pedestrians. In 2022, so far, nearly 100 people have died in crashes through June 2, across the city, according to the New York City Department of Transportation.

Violation of Laws

As New York personal injury lawyers, we have seen many factors that can cause or contribute to pedestrian accident fatalities and injuries. In this particular case, a motorist failed to yield the right of way to a pedestrian crossing a road in a marked crosswalk. Reckless and negligent (careless) drivers are the biggest threats pedestrians face in New York City.

Under New York law, all motorists are required to come to a stop at crosswalks and only proceed when pedestrians have crossed the roadway and it is safe for them to proceed. However, we see motorists constantly violating these laws, particularly at street intersections when they make a turn. It is also required under New York law for motorists to remain at the scene of an injury or fatal crash.

Compensation for Injuries

Pedestrian accidents have the potential to result in major injuries or even fatalities. Injured victims of pedestrian accidents and bicycle accidents can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in pedestrian accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.

When the driver is apprehended in a hit-and-run case, he or she can be held financially liable for the injuries, damages and losses caused. Such drivers can be held financially responsible whether or not they are arrested and/or charged. If a hit-and-run driver has injured you, please remember that you can seek compensation through the uninsured motorist clause of your auto insurance policy (even though the driver has not been identified) or through a quasi-state agency if there is no motor vehicle in the victim’s household.

Pedestrian accident victims and their families should also remember that they can seek compensation for injuries or losses in collisions even if the victim was not walking in a marked crosswalk and even if the driver involved in collision was not charged. Our law firm recovered the full one million dollar insurance policy for a girl who was not in the crosswalk when a motor vehicle hit her.
