Hit and run accidentA 34-year-old man has been charged with manslaughter in connection with a hit-and-run crash that killed a 31-year-old Queens woman. According to a CBS New York report, the fatal crash occurred on the Van Wyck Expressway in the Kew Gardens section of Queens. Responding officers found the woman unconscious and unresponsive at the scene with severe trauma to her body. She was transported to Jamaica Hospital where she was declared dead. Investigators said the truck headed north on the Van Wyck after striking the victim. Police determined that the man whom they arrested was the driver of the truck.
Leaving the Scene of an Accident
It is a crime in New York to leave the scene of an injury or fatal accident, regardless of whose fault the accident may have been. New York law requires all drivers to stop immediately at the scene of the crash. Motorists are also required to contact the authorities and exchange information with the other parties involved in the incident. In case of injuries, drivers are required to do what they can to help the injured victim. It could be something as simple as picking up your cell phone and calling 911. The medical attention an injured accident victim receives immediately after an accident can make the difference between life and death.
Challenges Faced By Hit-and-Run Victims
Hit-and-run victims are often left paying hefty medical bills and hospital costs because if the driver is not found, there is no one to hold accountable. If the driver is found, he or she can be held financially liable for the victims’ losses in addition to facing criminal charges. However, it is important to remember that the verdict in the criminal case may not result in full financial compensation for victims. Although a victim may receive some money in restitution, the person may not be entirely compensated for his or her losses and damages. An experienced personal injury lawyer will be able to advise victims and their families about how their own auto insurance policy might apply to a hit and run crash where the driver has not been found, or, in an incident where the at-fault driver is uninsured or underinsured.
