Maintenance Workers Say Oculus at WTC Poses Slip and Fall Hazards

Workers at the World Trade Center Oculus claim that the mall and transit hub continues to leak, posing serious slip-and-fall hazards to visitors and commuters. According to a news report in the New York Post, recent rain has resulted in puddles and slippery floors near the balconies and elevators on both sides of Ground Zero’s $4 billion transit hub. Workers say they soak up the water and drain it and it’s turning out to be a lot of nonstop work.

Leaks Are Causing Fall Injuries

Port Authority officials are blaming the leak on a nearby construction project and are claiming that there are no leaks. Post reporters say they saw the leaks firsthand and stated that the water often “leaves the marble floor more like an impromptu ice skating rink, making it dangerous for visitors.” One maintenance worker told the Post that people do have accidents. On a recent rainy day, he said, someone “almost broke their neck” on the marble floor.

Workers at the site told the New York Post that the construction of the ambitious building was a rush job that left many loose ends. Even though the Oculus opened in August, construction workers are putting the finishing touches on it because a lot of work was incomplete. Workers also told the paper that the design of the building makes the interior weather very uncomfortable. In addition, the new escalators are also breaking down and malfunctioning frequently, they said. In February, a woman died at the Oculus after she fell 30 feet from an escalator.

Common Causes of Slip-and-Fall Accidents

Slip-and-fall accidents, when they do occur, can result in catastrophic or even fatal injuries. Here are a few common causes of slip-and-fall or trip-and-fall accidents:

• Spills: When water or other liquids collects on the floor and is not mopped up right away, it could pose a serious slip-and-fall hazard.
• Weather-related conditions: Rain, ice or snow can cause slippery conditions both inside and outside a building and lead to passersby and visitors slipping and falling.
• Stairs and escalators: When stairs are slick or when escalators break down suddenly there is the danger of slip-and-fall or trip-and-fall accidents. Falling down from such a height could result in fatal injuries.
• Unrepaired walkways: Walkways that are uneven or damaged can cause victims to trip and fall as well.
• Lack of proper lighting: When lighting is inadequate, it hampers visibility and increases the danger of slip-and-fall or trip-and-fall accidents.

Who is Liable?

If you have been injured in a slip-and-fall or trip-and-fall accident, the owner and/or manager of the property where you suffered the injuries can be held liable. Property owners and/or property managers are required under the law to keep their premises safe for tenants, customers and visitors. When an accident occurs because a property owner and/or property manager failed to repair or maintain the premises in a timely manner, then they could be held financially responsible for the injuries, damages and losses that result. Injured victims can seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc.

Contacting an Experienced Lawyer

If you are unable to move after your fall, wait for emergency personnel to arrive. File a report with the property owner and/or property manager. If possible, take photographs of the dangerous condition that caused your fall. Obtain contact information from anyone who may have witnessed the incident. It is also important that you get prompt medical attention, treatment and care for your injuries. Make sure that you document all of your losses including all medical bills, physical therapy expenses and the number of workdays you missed as the result of your injury.
