LIRR Train Derailment Injures 33 People

traincrash At least 33 people were hurt in a train accident on Long Island after a Long Island Rail Road (LIRR) commuter train and another work train, which was performing track maintenance sideswiped each other the night of Oct. 8. According to a WABC news report, this caused the commuter train to derail. The train was carrying 600 people and derailed near New Hyde Park. The injured included 26 passengers and seven employees. Four of the injuries are said to be serious.

Ongoing Investigation
The LIRR train was reportedly heading east to New Hyde Park just after 9 p.m. when it sideswiped the work train. Two passenger cars then tipped over. It is not clear if the work train was moving, but witnesses said it caught on fire with smoke soon filling the commuter train. Rescuers removed passengers from the train. Governor Andrew Cuomo said it appears that the work train somehow violated the clearance space of the LIRR commuter train. Officials are still looking into why that occurred. Our thoughts and prayers go out to all who were injured in this crash.
Many passengers in the Long Island train said they panicked immediately after the collision as the Hoboken train accident that had occurred barely 10 days ago was still fresh in their memory. In that incident, a commuter train crashed into the Hoboken Terminal killing one passerby and injuring at least 100 other victims. Investigators have said based on preliminary investigations that the train was traveling at more than twice the speed limit as it had approached the Hoboken terminal.
What to Do After a Train Accident
If you have been involved in a train accident, you may be undecided about the next steps to take and may be wondering how to pay your medical bills and other expenses that stem from such a traumatic event. It is important to understand that you do have legal rights as the injured victim. If you are in a position to do so, talk to investigators at the scene so your name is on the report. Also, obtain a copy of the investigative report.
Often, train accidents result in serious injuries. So, you may require emergency transportation and treatment. It is crucial that you get the treatment and care you need right away. If you are unable to be at the scene because you are injured, have a family member or friend take photographs of the accident scene as well as talk to anyone who may have witnessed you getting injured.
Save your train ticket. Maintain a journal of your experience including your treatment and how you feel physically and emotionally in the aftermath of the crash. Keep track of the number of workdays you miss because of your injuries and the time it takes to recover. Contact an experienced train accident lawyer who will stay abreast of what can be a lengthy investigation, guide and assist you through what is usually a complex claims process. Such accidents and injuries often affect not just victims, but also their family members because of the emotional and financial toll it takes on them.
Compensation for Injured Victims
Victims of train accidents often suffer major injuries including traumatic brain injuries, spinal cord trauma, multiple broken bones and internal organ damage. Most of these injuries take a significant amount of time to heal, which means victims may not be able to return to work for many months. In some cases, victims suffer catastrophic injuries, which means they may never be able to return to work or earn a livelihood after. Depending on the nature and circumstances of the incident, injured victims can seek compensation from the at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc.
