Large Truck Accidents Involving Bicyclists Increase in New York City

A 21-year-old man was struck and killed in a bicycle accident in the Bronx involving a dump truck early morning on Aug. 29. According to news reports, the victim was on the Cross Bronx Expressway when he was hit by a 2013 Peterbilt dump truck that was traveling east in the center lane. Police found the bicyclist unresponsive on the side of the road in Soundview. The driver of the dump truck did not stop, but police tracked down the truck driver who told them he did not realize he had hit someone. No charges have been filed and the fatal truck accident remains under investigation.

Collisions Involving Large Trucks

Safety advocates are worried about large trucks causing an increasingly disproportionate amount of fatal crashes and major injury accidents on New York City’s streets. Last month, a 30-year-old artist who was biking through Sunset Park was killed after she swerved to avoid an open car door and was struck by a tractor-trailer.

These large trucks that are involved in pedestrian and bicycle accidents in New York City include big rigs, delivery trucks and dump trucks, etc. These large vehicles make up only about 3.6 percent of vehicle traffic in New York City. But of the 18 bicyclists killed in 2019, 10 were struck by truck drivers. And 30 percent of bicyclist fatalities since 2014 involved large trucks.

Safety advocates say that some of the factors responsible include the trucks’ challenge in seeing – particularly dangerous on streets that have many pedestrians and bicyclists, as well as roads that were not built to handle such large vehicles. Also, most of these truck drivers are not required to get a Commercial Driver’s License or CDL because they drive trucks weighing less than 26,000 pounds and do not have air brakes. Drivers who have CDLs are better prepared and better trained to drive larger vehicles. Another factor leading to the spike in such types of crashes is the skyrocketing popularity of online shopping that puts more delivery trucks on our streets.

New York City has had its share of problems with dump trucks striking pedestrians and bicyclists. Mayor Bill de Blasio’s Green Wave cycling plan released after 17 bicyclists were killed this year in the city, calls for the NYPD to target enforcement on large trucks. The plan also intends to create a Truck Safety Task Force, leverage public-private partnerships and expand the city’s off-hours delivery program.

How an Experienced Truck Accident Lawyer Can Help

All traffic accidents involving large trucks have the potential to result in major injuries or fatalities. When these trucks strike pedestrians or bicyclists, there is a significantly higher risk of a catastrophic or fatal injury. A victim who has been injured by a truck driver will be able to hold the driver and his employer and/or the trucking company accountable for the injuries, damages and losses caused. Injured victims can seek compensation for damages including, but not limited to, medical expenses, lost income and benefits, hospitalization, cost of rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families of deceased victims may also be able to seek compensation by filing a wrongful death lawsuit.
