Four children have fallen from windows in NYC in the past five months. Some city officials are calling for action from Mayor Zohran Mamdani, according to a report in the New York Post. All four children survived their falls. The most recent fall happened earlier this month in the Bronx when Dylan Moquete, 5, was critically injured after he fell from a fifth-floor window at 30 Buchanan Place.
Dylan reportedly crawled out the window while his adult sister was cooking. The boy landed on the pavement 50 feet below. He was transported to New York-Presbyterian Hospital in critical condition with multiple fractures. A family friend told the Post that the child’s fall was cushioned by trash left outside. Issues with Window Guards
The Post reports that the building’s windows were not compliant with the city’s window guard law. The city law requires guards in all windows that aren’t emergency exits in apartments where children under the age of 10 years live. A Health Department spokesperson told the Post that the windows at this building were not properly installed as required as they allowed a space of more than 4.5 inches.
In April, a 5-year-old boy fell out of a third-floor window at 484 East 167th Street in Morrisania. In that building there was no window guard because the window faced a fire escape. The child’s mother told the Post she had asked her landlord (building owner) for a window gate, which is removable, but that he refused. On July 17, 1-year-old boy fell from a fifth-floor window at 593 Oak Terrace in Mott Haven. The building management installed guards in the apartment, but only after the Health Department instructed them to do so, after the child’s fall.
The Post reports that the in the last fiscal year that ended on June 30, the city’s Department of Housing Preservation and Development (HPD) issued at least 5,869 window-guard violations in NYC. While that’s a 17% drop compared to the previous year, it’s still a high number. City Councilman Phil Wong called for the city to do a review to determine if the window guard law is being properly enforced.
