Fatal Staten Island Car Accident

A 90-year-old man identified as Gerardo Avila, was pronounced dead and two others — a 70-year-old woman and a 6-year-old girl — were listed in critical condition after a Staten Island car accident the morning of Jan. 2. According to a report in the Staten Island Advance, the fatal crash occurred at the intersection of Forest Hill Road and Rockland Avenue in New Springville. Police responded to a 911 call involving two SUVs. A 50-year-old man driving one of the SUVs was traveling west on Rockland and attempted to turn onto to Forest Hill Road when he struck a southbound SUV driven by the 70-year-old woman.

FDNY officials said the adults suffered serious injuries. Officials said Avila was sitting in the front passenger seat and the 6-year-old girl was a rear passenger. No arrests had been made during the weekend and officials are still investigating the cause of the fatal collision. We offer our deepest condolences to the family of the deceased victim and wish those injured the very best for a speedy and complete recovery.

Left Turn Collisions

Left-turn collisions at intersections are common in New York City and often result in severe injuries and fatalities. Under New York Vehicle and Traffic Law § 1141, a driver making a left turn must yield the right of way to oncoming vehicles that are close enough to constitute an immediate hazard. When the driver making the left turn fails to yield and causes a crash, that driver is frequently found negligent (careless).

One of the most common causes of such collisions is the failure to yield the right of way to oncoming traffic. Drivers may misjudge the speed of the approaching vehicle or try to “beat the light,” leading to a crash. Distracted driving is also often another major factor in addition to speeding. Other common causes include reckless driving or violation of red light and other traffic laws. These types of collisions also tend to result in major or even catastrophic injuries such as traumatic brain injuries, spinal cord damage, internal injuries, bone fractures, etc. These types of injuries can become permanent and result in lifelong disabilities as well.

Contacting an Experienced Lawyer

Injured victims of negligent (careless) drivers can seek compensation from at-fault parties for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, rehabilitation, permanent injuries, disabilities, past and future pain and suffering, etc. Families that have lost loved ones in car accidents can seek compensation for damages such as lost future income, medical and funeral costs, pain and suffering, etc.

If you or a loved one has been injured in a car accident, or if you have lost a loved one in an auto accident caused by a negligent (careless) driver, the experienced New York personal injury attorneys at the Law Offices of Kenneth A. Wilhelm can help you better understand your legal rights and options, and also fight hard to recover just compensation for you. It is in the best interest of injured victims and their families in such cases to contact an experienced personal injury lawyer before contacting the people responsible for the injuries, and definitely before contacting or communicating with any insurance company, or their lawyers, investigators, or adjusters.
