A 32-year-old bicyclist was killed in a hit-and-run crash in the Hamilton Heights section of Manhattan the night of June 19. According to a WABC news report, police said the fatal bicycle accident occurred near West 151st Street and Amsterdam Avenue. Police said a black SUV was traveling south on Amsterdam Avenue when it struck the bicyclist.
The driver then fled the scene without stopping. Emergency crews responded to the scene of the crash and transported the bicyclist to Harlem Hospital where he died from his injuries. The victim’s identity has not yet been released and no arrests have been made. Police are searching for the hit-and-run vehicle and the investigation is ongoing. New York Hit-and-Run Laws
New York laws require drivers involved in any accident to stop, provide identification and report the incident if there is injury, death or property damage. Leaving the scene without doing so is a criminal offense. If the accident involves only property damage, fleeing can result in misdemeanor charges, fines and possible license suspension. However, if a bicyclist or another person is injured or killed, leaving the scene becomes a more serious crime, potentially leading to felony charges, higher fines and even imprisonment. Drivers are also required to notify police promptly when injuries occur. Failure to report can lead to additional penalties.
In a hit-and-run collision, the driver and vehicle owner are both responsible parties even if the owner was not driving when the accident occurred. If the driver was on the job and/or operating a company vehicle at the time, his or her employer can also be held liable.
